DESCRIPTION OF SERVICES

My Healing Hands Massage also known in short as MHH Massage, and will be used throughout our terms and conditions, and privacy policy as mentioned, is the premier provider of massage services specifically for in-call massage services at set studio location, along with a variety of alternative therapy services in Houston, Tx . All massages are strictly professional by a licensed and insured Massage therapist. MHH Massage will provide all services as booked by individual client(s) along with all equipment necessary to include massage lotion or oil, sheets, and comfort support amongst the minimal items used during a client session. Alternatively other medical grade equipment may be used during the duration of our services upon booking request or as authorized by client if or when therapist recommends use for specific wellness outcome. Additionally services may become available for customers to book contractors "Independent Practitioners" under MHH Massage.

 

USE OF OUR SITE

Our Terms govern your use of our website (“ Our Site ”) and also our App (“ Our App ”) and telephone and email booking services (collectively “ Our Booking Services ”). By using Our Site or Booking Services, you agree to abide by Our Terms.

CONSUMER TERMS

 

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2024 requires MHH Massage to give you certain key information for there to be a legally binding contract between you and us. This information is set out below (and is also linked in the email we send to you to confirm any booking you make through us with an Independent Practitioner or main head therapist of our main in-call location studio). We conduct contracts currently and only in the English language. If you do not understand the english language as written, you are advised to have a representative guide you through our terms and conditions and privacy policy and interpret on your behalf before agreeing to our terms and conditions.

MHH TERMS OF SERVICE

​

The Services we offer allow you to search through Our Website and purchase Massages from a number of Independent Practitioners. As part of the Services, we also provide some ancillary services such as arranging such bookings and providing you with customer service assistance.As stated above, the contract for the purchase of the Massages is between you and the Independent Practitioners. This means that it is the Independent Practitioner who is legally responsible for providing the Massages.

 

However, MHH Massage remains responsible in its obligations to you in accordance with these Terms and Conditions which are legally binding. If you have any questions, complaints or requests for refunds, we can be contacted directly via our contact page, or by utilizing the information at the bottom of our website @ www.myhealinghandsmassage.com, additionally by reaching out to us directly at 832-303-9674 or by email: info.myhealinghandsmassage@gmail.com and our customer service will be in touch to organize any help we may be able to provide. MHH Massage will remain the point of contact for the Customer for Customer Service questions or any help related to booking massage services via our dedicated website.

MHH Massage shall, if requested, provide intermediary services between you and Independent Practitioners in terms of Customer Service or dispute resolution matters. In order to use the Services you must be over 18 years of age. We cannot offer Massages to pregnant women in their first trimester (12 weeks) of pregnancy. When booked by us, the Massages you receive will be subject to the Independent Practitioners terms and conditions as set out in the Client Consultation Form (“ Independent Practitioners”) which are only available by the practitioner themselves. You will be asked to confirm your acceptance of them prior to receiving the Massage Services. The Independent Practitioners will form the basis of your agreement with the Independent Practitioner for your Massage (each a “ Massage Agreement ”). MHH Massage is not a party to any Massage Agreement: this is solely between you and the Independent Practitioner who provides you with your Massage.

ELIGIBLE USE

​

 You confirm that you are of legal age to access and use Our Website and/or Our Booking Services and of legal capacity to agree to Our Terms. You are not eligible to use Our Booking Services if you are under the age of 18.

PAYMENT & FEES

​

• Payment is due at time of booking through our online secure payment system from our main website.

•  Unless otherwise agreed during the booking process, payment is only be accepted by debit/credit card. 

• Your card payment details will be requested at the time of booking and payment will be collected when you make a booking along with any taxes pertaining to your reservation.

• Full payment of the Massage Fee is due at the time of booking. Full details of the prices are referred to you before checking out for payment from the website services.

• Service fees listed at time of booking is the amount you will be charged, prices subject to change any time without notice. The final cost will be listed before your enter your credit card information.

• From time to time due to location, time of the day, length of massage and number of massages, or massage event whether corporate or private booking for mobile services (only guarantee by therapist upon availability and deposit as required to confirm set service date) prices may change or differ from web online booking rates. The final cost will be listed or provided to customer before your enter your credit card information.

• Gratuity is automatically included in the massage rate as listed on our website under "services" and may include between 15-20%. Gratuities are also accepted in cash upon completion of the massage services.

BOOKING PROCESS

​

• Unless otherwise agreed during the booking process, payment is only be accepted by debit/credit card online via website of MHH Massage.

• Your card payment details will be requested at the time of booking and payment will be collected immediately when you make a booking.

• The Massage Fee belongs to the Independent Practitioner who provides the Massage. MHH Massage only collects the Massage Fee from you as their agent.

• For each booking made through us, we charge the relevant Independent Practitioner an agreed fee (plus any VAT payable thereon) for introducing you to that Independent Practitioner ("Our Agent's Fee").

• We have an agreement with each Independent Practitioner under which we are entitled to deduct Our Agent's Fee from the Massage Fee paid by you for the Massage.

• We will do all that we reasonably can to ensure that all of the information you give us when paying for the Massage is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on the part of MHH Massage, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorized access to any information that you may give us at any time.

• All payments by credit card or debit card need to be authorized by the relevant card issuer. We may also need to use extra security steps via Verified by Visa.

• By making a booking you agree to provide complete, correct and true information including and without limitation billing and payment information.

• Once your booking is accepted and confirmed by the Practitioner (the Independent Practitioner), you will receive confirmation of your appointment by email with all booking details.

As the lead person making the booking, you are responsible for:

• Full payment of the applicable Massage Fee;

• Ensuring the Independent Practitioner has access to your Designated Premises which must, in all cases, offer a suitable space in which the Massage can be performed, with all appropriate facilities (including, adequate lighting and heating) and having some form of dedicated parking spaces ensuring that your practitioner will have an accessible ease of access to your front door as they are loaded with a massage table and any and all applicable medical equipment needs (if any).

• Providing as necessary, any additional booking and Massage information to other individuals participating in the Massages booked; and

• Ensuring the health and safety of the Independent Practitioner whilst at your Designated Premises.

All Massage Fees are payable through Our Website or over the telephone as part of our telephone booking service. As noted above, we collect payment of Massage Fees on behalf of the Independent Practitioner to whom we charge Our Agent's Fee.

 

Please note that all fees and charges are exclusive of VAT and VAT will be charged by the Independent Practitioner at the prevailing rate where applicable.*

CANCELLATIONS

​

• All reservations shall be supported by providing a valid credit card used for online booking or in-person.

• Cancellation made before 24 hours of your appointment time will be refunded in full.

• Cancellations made before 5 hours of your appointment time on the same day will be refunded in half.

• If you do no not show up, are more than 15 minutes late, cancel without rescheduling for your scheduled appointment you will be charged full price for the scheduled service, no exceptions.

• Therapist retains the right to terminate massage at any time for inappropriate conduct from the client. This includes but is not limited to inappropriate touching, vulgar language, harassment or intoxication on the part of the client. If a massage is terminated "no refund" will be paid to the client, no exceptions.

• My Healing Hands Massage retains the right to arbitrate disputes between contractor and client and determination shall be final, in the event MHH Massage has independent contractor for mobile or on-site.

MEDICAL WAIVER & DISCLAIMER

​

MHH Massage provides therapeutic massage therapy services. Client agrees to provide any known medical conditions, illnesses, or current and past injuries that might be effected by massage services to include pre-natal massage. MHH Massage is unable to provide 1st Trimester pre-natal massage until no less than 2nd trimester for the health and safety of the unborn child and mother's wellness. It is the responsibility of the client to disclose any medical conditions to MHH Massage before the start of your massage. Medical conditions include but are not limited to: Heart conditions, stroke, diabetes, skin conditions and cancers.

 

MHH Massage does not diagnose any medical conditions or provide referral for medical treatment or tests. MHH Massage may offer clients a recommended professional within the same line of therapy or other alternative or wellness medical resources not related to MHH Massage for consideration, but is not attached to any liability from accepting and upholding services rendered from any medical physician or other alternative therapies as listed. Resources available through MHH Massage are strictly for personal use and not related to any medical conditions outside of the scope of practice of MHH Massage, its owner(s), independent contractors, and any known entity working besides MHH Massage. We are not responsible for resources shared to any client and the outcome of the treatments received.

 

INDEMNIFICATION

Client agrees to indemnify and hold MHH Massage, officers, contractors and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of use of any person, facility, or services as provided by MHH Massage.

 

RESPONSIBILITY

​

Massage Therapist is provided solely by founder and main therapist at on-site main location. In the event that any independent contractors through MHH Massage are dispatched via our website from customer booking (if and when mobile services are available) which includes off-site booking with main therapist of MHH Massage. All contractors are solely responsible for their actions in connection with the above. None of the contracted Massage Therapists are employees of MHH Massage, they are solely independent contractors. MHH Massage acts as only a referral service providing access to qualified licensed Massage Therapists in Houston, TX. (if any). Client agrees to hold MHH Massage free from any liability resulting from any actions or interactions of any physical Massage Therapist recommended via dispatch resulting from customer booking requests by MHH Massage.

 

LIABILITY CAP

Except where prohibited by applicable law, the aggregate liability of MHH Massage, its affiliates, agents and their respective officers, directors, shareholders, employees, contractors, representative and agents to you for all claims arising from or relating to this agreement, or your use of the services including without limitation, your interaction with any therapist(s) or other customer(s), any cause of action sounding in contract, tort, or strict liability will not exceed the greater of: (A) the total amount received by MHH Massage from you during the six-month period prior to the act, omission or occurrence giving rise to such liability, or (B) $100.

PRIVACY POLICY

​

Any information received from clients shall be deemed strictly personal and confidential and Massage Therapist and Professional MHH Massage agrees it shall not divulge any information received from client to any person or entity without such clients prior written consent except where applicable by aggregate law.

ASSIGNMENT OF BENEFITS

 

I am responsible for all charges for service(s) provided by MHH Massage. I am responsible for any balance due if or when partial payments have been made online and a remainder balance is due upon completion of services. In the event I get booked via communication by phone and provided an email address and mobile contact has been confirmed, and I do not show up, or show up later than 15 minutes past the allotted time and was cancelled by my therapist (as a no-show), I am responsible for the remaining balance due and owner/therapist has the right to charge my credit card for the remaining balance plus any applicable fees (if any). I am responsible for my time and agree that in the event I show up late, my therapist has the right to end my session at the same time as originally scheduled and will not extend any further length of time as a result of my tardiness. 

 

RELEASE OF MEDICAL RECORDS

 

I authorize the release of medical records or other health care information, including intake forms, chart notes, reports, correspondence, billing statements, and other written information to my attorneys, in the event that I am in need of my records being disbursed for personal reasons that do not include MHH Massage directly.

CLIENT AGREEMENT CONTRACT OF CARE

 

It is my choice to receive massage therapy. I am aware of the benefits and risks of massage and give my consent for massage with MHH Massage and its therapist or independent contractor(s). I understand that there is no implied or stated guarantee of success of effectiveness of individual techniques or series of appointments. I acknowledge that massage therapy is not a substitute for medical care, medical examination or diagnosis. I have stated all medical conditions that I am aware of and will inform my practitioner of any changes in my health status. 

 

I will participate fully as a client/member of MHH Massage. I will make sound choices regarding my sessions and any plan based upon the information provided by my massage therapist. I agree to participate in my own self-care programs and adhere to the plan we select. I agree to communicate with my practitioner any time I feel my well-being is being compromised. I expect my practitioner to provide safe and effective treatment to the best of his or her skills and knowledge and within the scope of their practice.

 

Signature of parent or legal guardian is required to consent if a minor is to be treated for massage services or for personal fitness coaching within MHH Massage as well as any independent contractor dispatched by MHH Massage in any event of massage services and fitness coaching alike.

 

I acknowledge that my therapist has confirmed an appointment time which will be exclusively reserved for me. Failure to provide 24 hours notice of cancelation may result in my account being charged for the therapist time.

 

I authorize and direct payment of medical benefits to my massage therapist, for services billed.

 

I acknowledge that I have read & understand all the above terms & conditions, and privacy policy.

I acknowledge that I am over 18 years and the sole responsible party for my booking services or have assigned a dedicated person legally authorized and over 18 years of age that can speak and consent on my behalf.

I acknowledge that by clicking on "I agree to MHH Massage Terms & Conditions" and "Privacy Policy", I am consenting that I have read, understood, and agree to all terms, condition, and policies of MHH Massage.
